Hey all,
I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.
I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.

I am currently studying in the US on an F visa and have managed to loose my passport a couple of months ago. The passport itself is replaced but I hesitated to renew the I-94 since it takes longer time than my duration of status and it is cheaper to just leave the country and send a mail to USCIS later with proof of departure.
To the problem, I am changing status from F to A. Since the interview is not required I was able to obtain the new visa through mail. Now, I am currently in the US with a valid new visa but no I-94 which means I will be out of status two months after my F visa expires. Being close to the Mexican border my plan is to cross it and come back on the same day to officially get the A status and a new I-94. I will of course send photocopies of all the papers and stamps to USCIS to not fall out of status on the previous visa. Are there any legal problems doing this?

My parents-in-law visited the USA in the last week on B1/B2 visa. At the port of entry the immigration officer marked the expiration date on I-94 for my father-in-law for 6 months and however did not mark the expiry date on my mother-in-law�s I-94.
As they are visiting first time they did not know the procedure and they could not bought this to the immigration officer�s attention before they left ?
I assume they entered the expiry date in the system for my mother-in-law since both applications were processed at the same time with the same officer.
How this can be fixed ?
Is there any way I can call DHS and confirm the I-94 expiry date in the system ?

Hi - I am just wondering, if Medical residency applications are subject to the yearly 65,000 Quota? Does anyone know?
If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.

- recently obtained a duplicate passport for my stolen passport, unfortunately also lost I-94 when received in Dec.08.
- Can I use the I-94 attached in the bottom of the I797? I won't have time to submit I102 and wait for replacement I-94.
- I've a trip coming very soon to Germany, last year had obtained the H1b stamping at US consulate in Germany, will it be ok if I apply for restamping at the same consulate because of time factor I'm not able to Canada or Mexico or India.
Any help and advise will be much appreciated. thanks !

I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.
Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
(2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
(3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?
I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

Right now i m on H1B. I recently got married and my husband is on H1B he didnt start his GC process yet. At this stage can i add him on my green card. If so pls explain me the process ...

The questions is, if i have an approved I-140 from Company A and I switch over to Company B, then would i be able to file my 485 based on 140 related to Company A when my PD for Labor (company A) becomes current.

I know a friend who has done Bachelors in Computer Application in india. She is now in US and wanted to know the options for working or studying in US.
Is she eligible to take up MS degree..???

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...
