Hello,
My husband is on pending I-485 MTR & my denied I-140 is in appeal. My husband has to apply for H-4 status based on my approved & stamped H-1 status.
My Queries:
1) I am told that he cannot apply from USA as his I-485 is denied and he is pending I-485 MTR?
2) Can he apply for canadian visa for H4 consulate processing even though he doesn't have valid USA stamp on his passport? All we have is pending I-485 MTR receipt & my pending appeal letter from AAO office.
3) How safe is it to apply from canada?
Your response will be highly appreciated.

You have to return both I-94's while ticketing ie before exiting and while entering at POE IO will give you new I-94 based on AP as Paroled AOS pending..
Ofcourse keep your copy of I-94 from your H1 Extension I-797 approval notice.

I have filed for my I-485 application (based on a approved I-140) in July 2007. At that time I also filed for another I-140 based on a substitute labor that I got which had a earlier priority date.
Now that new I-140 that I filed with substitute labor is approved. I am looking at possibility how I can use this new I-140.
I heard there is something called changing underlying I-140 application. Can someone explain this and tell me how I can use it in my case please.

I have applied for GC in Aug '07. I recently renewed my H1-B (7th year). I noticed that there is a mistake in the A# of my Green card application (Beneficiary #) on the H1-B approval notice.
Has any one else had this happen? Does any one know what can be done regarding this?

prevailing wage calculations for EB-2 applications to be filed for Sr. Systems Analyst and Sr. Software Engineer. I did send my wife's and my daughter's RFE in one package. But have separate cover lettter and folder. One packet is enough, clearly distiguish between two set of papers.

Hello Everyone,
I need some suggestions from you guys.
My Employer A filed my green card labor in April 2000.
I was working with them on H1B till May 2003.
I moved to Employer B on H1B in May 2003.
Employer A continued to process my GC, and they filed my I485 in Jan 2007. I paid for the expenses.
My I485 is now pending at TSC.
Also Employer A confirmed they will support till i get my GC and I don�t have to work for them.
Can I use AC21 portability to move to another employer C using my EAD?
Do you see any issues i may face since i am not working for employer A?

To be on the safer side, I would to like have another H1 from company C, so that if anything happens with I-485, I can join company C on the H1.
Is this possible? Do I have to travel out of country in order to work for company C on H1?

Since everything is current now, and happy as I am, it jumped quicker on me than i anticipated. I am in precarious position to apply I-485 right away or see it get retrogressed again.
My dilemma is that I am unmarried and want to get married to someone in India, but also take my time selecting my mate.
My question is if I apply for I-485 in july or august, how much time do I have to get married in India and still make my spouse eligible for green card with me.
