    I'm currently getting everything ready to mail my forms to get a green card through marriage. I've heard that I would have to send an employment verification letter from his boss. But some people say it's optional, I only send it if I want to because he's already got his taxes done proving he can afford to support me.

    If I do have to send the letter, do I need anything else along with it as proof? Either to mail them alongside the letter or for the interview?

    Any help will be much appreciated. I've heard conflicting stories and don't know what to think.

    The USCIS announced on June 1, 2006 that the regular H-1 cap for Fiscal Year 2007 (FY2007) was reached on May 26, 2006. Those cases properly filed with the USCIS before the 26th are safe, with respect to the cap, as there are enough cap numbers for these cases. Cases that reached the USCIS on May 26th are in an uncertain situation and will be subject to a random selection process, as there are enough numbers for some, but not all of the May 26th cases. Any regular cap-subject cases received after May 26th will be rejected entirely.This information does NOT impact advanced degree cases, for which cap numbers are still available.

    I am on 8th H1b extension with approved I140 and 3yr extension. Now I want to join a new company, who does my H1B and will get 3yr extension on that. If my parent employer revokes my I140, will my new H1B (with new employer) gets void ? or is it still valid for me to work with new employer for next 3 years. I dont want to apply for LC and I140 with the new employer as I will be R2I in August 2007.

    I am initiating this poll to find out priority date segments, as I could not found a poll for priority dates tracking.

    I have divided priority dates in eights segments. From the eight segments, I have created three specific segments from Jan 2004 to June 2004, June 2004 to Dec 2004 and Jan 2005 to March 2005. The people in these segments are most likely to get their GC (If USCIS process in FIFO manner) as soon as the backlog with priority dates before 2003 is cleared. The first three months of 2005, Jan to March, when lots of people applied, just before a new PERM labor certification process was introduce. This will help separate the three months from the rest of the year 2005.

    Please join me to track priority dates which is the key date for GC approval.

    My friend just forwarded me this link and it shows 1-jun-2006 priority date for EB2. For EB3 it still shows Unavailable. However US State website still shows old dates.

    U.S. Citizenship and Immigration Services (USCIS) will make available Premium Processing Service for designated Form I-140 petitions1 (Immigrant Petition for Alien Worker) filed for alien workers in H-1B nonimmigrant status who are reaching the end of their sixth year in H-1B nonimmigrant status. Starting on June 16, 2008, USCIS will begin accepting Form I-907, Request for Premium Processing Service, for Forms I-140 filed for alien beneficiaries who, as of the date of filing the Form I-907:

    * Are currently in H-1B nonimmigrant status;
    * Will reach the end of their 6th year of their H-1B nonimmigrant stay in 60 days;
    * Are only eligible for a further H-1B extension under AC21 �104(c)2 upon approval of their Form I-140 petition; and
    * Are ineligible to extend their H-1B status under AC21 �106(a)3.

    Hello,

    I am currently working for employer A on a 6th year H1 with approved 140 petition. MY current H1 is expiring June 2010. In the meantime I got an good offer from employer B who applied for H1 transfer using my approved 140 petition and I got an RFE. My question is god forbid , that if my H1 transfer petition is denied with employer B , can I continue working for Current employer A and if he can file for my H1 extension, come June? Also would there be any recursions, considering i already applied the H1 transfer now with the new employer ?

    Please advice and i thank you in advance

    Hello Everyone,

    I need some suggestions from you guys.

    My Employer A filed my green card labor in April 2000.

    I was working with them on H1B till May 2003.

    I moved to Employer B on H1B in May 2003.

    Employer A continued to process my GC, and they filed my I485 in Jan 2007. I paid for the expenses.

    My I485 is now pending at TSC.

    Also Employer A confirmed they will support till i get my GC and I don�t have to work for them.

    Can I use AC21 portability to move to another employer C using my EAD?

    Do you see any issues i may face since i am not working for employer A?

    WASHINGTON, Dec. 10 � Ed Gillespie made a name for himself in 1994 as a sharp-tongued pitchman for the Contract With America, the conservative Republican manifesto that catapulted his boss, Dick Armey, to power. But when Republicans shut down the government in a spending clash with President Bill Clinton, Mr. Gillespie warned it was the wrong battle to pick.

    �He understands the limits of what you can expect people to buy,� Mr. Armey explained.

    Now, after a stint as Republican National Committee chairman and a lobbying career that made him a multimillionaire, Mr. Gillespie is back in government as a street fighter and salesman for conservative ideas and the politician behind them � in this case, President Bush. Once again, he is in the thick of a budget fight between the White House and Congress.

    But this time, he is driving the confrontation.

    As the clock ticks toward a Congressional recess, with Democrats struggling to wrap 11 major spending bills into one and Mr. Bush threatening to veto the huge package, Republicans see the hand of Mr. Gillespie at work. As counselor to the president, a job he took in July, Mr. Gillespie is trying to write a new narrative for Mr. Bush, one that casts him in the role of fiscal conservative, sharpening the contrast between him and Democrats while repairing his tattered image with the Republican base.

    On Mr. Gillespie�s watch, the president�s speeches have grown shorter, his language punchier. When Mr. Bush threatens to veto a �three-bill pileup� or likens Congress to �a teenager with a new credit card,� Gillespie-watchers all over Washington say they can hear the new counselor�s voice.

    �Ed believes that one of the reasons the Republicans lost is because we had lost our way on spending,� said Pete Wehner, a former policy analyst for Mr. Bush who left the White House this spring. �He worked for Dick Armey; I think he�s a small government conservative, and I think he believes Democrats and their spending habits are a target-rich environment.�

    And Democrats have provided targets, by waiting until two months into the new fiscal year to finish their appropriations work. Mr. Bush has already vetoed Democratic measures on children�s health and Iraq war spending, and a water resources bill � all the while complaining lawmakers are wasting taxpayers� money, and scolding them like errant schoolchildren who forgot to turn in their homework.

    �Listening to this, it has Ed Gillespie�s fingerprints on it,� said John Feehery, a Republican strategist. �It�s shaping the message to pick the right fights � with a smile.�

    After two decades in Washington building up contacts on both sides of the aisle, Mr. Gillespie knows well the importance of the smile.

    He also knows when he has to take the high road, and when he does not. In 2004, as party chairman, Mr. Gillespie was nicknamed Mr. Bush�s �pit bull� for his relentless attacks on Senator John Kerry of Massachusetts.

    Mr. Gillespie rarely gives on-the-record interviews � he declined to talk for this article � and he is almost never seen on television. And careful listeners to Mr. Bush will note that the president paints �Congress,� and not �Democrats� as the villain � another Gillespie hallmark.

    �He�s a smart, shrewd operator,� said Representative Rahm Emanuel, the chairman of the House Democratic caucus, who was a senior adviser to Mr. Clinton during the 1995 budget fight. But while Mr. Emanuel said he has �nothing but respect for Ed,� he argued that, after seven years of runaway Republican spending, even a master strategist like Mr. Gillespie will have trouble remaking Mr. Bush�s image.

    �He�s $4 trillion too late,� Mr. Emanuel said.

    At 46, Mr. Gillespie is part of a core of newcomers who are seeing Mr. Bush through the end of his presidency as his Texas inner circle breaks up. Unlike his predecessor, Dan Bartlett, who spent his entire adult life working for Mr. Bush, Mr. Gillespie not a presidential intimate, but neither is he a stranger.

    In 2000, he was a member of the Gang of Six, a group of strategists for the Bush-Cheney campaign. That same year, he joined with Jack Quinn, a former White House counsel to Mr. Clinton, to found Quinn Gillespie & Associates, his lobbying firm. He earned a reported $4.75 million when he sold his share of the firm to join the White House, but he could easily pass through Washington�s revolving door yet again, earning even more after Mr. Bush leaves office.

    Mr. Gillespie�s critics say he traded on his contacts to get rich. �He�s so entwined with the Bush money machine,� said Joan Claybrook, president of Public Citizen, a watchdog group.

    But his admirers say he has not forgotten his roots. His father, an Irish immigrant, ran a mom-and-pop grocery store and later a bar in their hometown, Browns Mills, N.J. Mr. Gillespie spent his college years serving drinks and sweeping floors � experiences that, friends say, shape his work in the White House.

    Mr. Gillespie has been deeply involved in Mr. Bush�s so-called �kitchen table agenda,� of issues like consumer safety and rising mortgage rates.

    �Ed�s got a pulse on what average Americans think about,� said David Hobbs, a Republican lobbyist and a Gillespie friend.

    The week before Mr. Gillespie officially took over as counselor, Mr. Bush�s immigration bill collapsed on Capitol Hill � and with it, any real hope of bipartisan cooperation. One senior White House official, speaking on condition of anonymity, said Mr. Gillespie wasted little time.

    �It went down in defeat, and he was moving on to the next thing,� this official said. �The next thing was Iraq and the budget.�

    On Iraq, Mr. Gillespie took advantage of the Congressional recess in August to schedule a series of presidential speeches. At the time, Republicans like Senators Pete V. Domenici of New Mexico and Richard G. Lugar of Indiana were expressing deep misgivings about the war, so much so that even some White House officials thought they would lose Republican support in September. But in the end, Republicans stuck with Mr. Bush.

    On the budget, Mr. Gillespie looked back to the Republican defeat of 1995. �We saw how Clinton did it, using the power of the presidency,�� Mr. Hobbs said.

    Mr. Armey said Mr. Gillespie had argued that his party would lose because the public believed Republicans were antigovernment, �so therefore it is credible to argue Republicans shut government down.�

    He said Mr. Gillespie�s strategy was to �understand the public�s already conceived disposition,� and create a story line around it.

    That strategy was on full display in the Rose Garden last week, as Mr. Bush tapped into another preconceived notion, that lawmakers are lazy. The president opened his remarks by tweaking Democrats on the 30-second pro forma sessions they held to prevent him from making recess appointments over the Thanksgiving Day holiday.

    �If 30 seconds is a full day,� Mr. Bush said, �no wonder Congress has got a lot of work to do.�

    It was positively Gillespie-esque.

    Hey HybridIllusion,
    It all depends on what format your 2d image is in. If it is in AI or EPS, you can automatically import the image into Swift 3D and animate it. If it is a JPG or GIF, you might have a few more steps before importing into Swift 3D.

    Take your image and import it into Flash. Export the Flash animation as AI (adobe illustrator) by going to File | Publish Settings | File Types tab. Check the AI box and then publish the movie. The image will be exported in the AI format. From the AI format, you can import into Swift 3D and animate with no limitations.

    There is a mistake in my 485 cover letter. The letter states that I am EB3 but actually I am EB2.

    Will this cause any problem? Will USCIS deny my case? Please note we included I-140 approval form in the file.

    Your cover Letter is not a USCIS document. As long as the actual application forms and supporting documents are good you should have nothing to fear.

    I came in 2003 on an H4 visa with my parents who were on H1B, I was 17 yrs old at that time. I then got my status changed to an F1 in 2004. I completed my bachelors and have been accepted into a masters program on a scholarship. I wanted to visit India, however I would like to know the risk involved in doing so. Would I still be at risk of not getting a f1 VISA in India even if I carry my approved F1 petition? Please advise..Thanks..

    You can even take an unpaid job/volunteer to keep you clear of the 90 days unemployed clause.

    I didnt know that even the OPT rules have changed now. This is a mess.
    Now OPT also you cant remain unemployed for more than 90 days. Now this OPT is becoming like another H1B.

    Is core group out of mind...Sueing will waste our funds..

    Please use this money for constructive tasks.

    Since first day, if u have tried to make I485 filing w/o priority date current..
    At least 90% of people wud have utilized AC21 and change employers.

    Ofcourse you always convince the higher authorities, to let us file 485s and issue GC, when dates become current.
    As long as we file 485 and utilize AC21, we will be in safe situation.

    Have some plan and result oriented plan.

    Thinking big is ok, but we shd know what actually we can do.

    Hi,

    If a H1B visa holder is in US, i know it is possible to transfer H1B to a different comapny in US. But can anyone help me understand if the same is possible if the person having the H1B visa is in india currently?

    Using H1B visa, the person has worked in US for first 3 years. Now the person has applied for H1B extension and still the petition papers have not yet come. After applying extension the person has gone back to India. The person's current company is hesitating to send him back to US.

    Question
    After getting the petition papers, can one transfer H1B visa to a different company staying in india itself and them come to US via new comapany?

    We are going to India on Vacation in Aug 2008. I am on H1B visa and my daughter (3 yrs) is on H4 (My dependent). My wife came to US as my dependent on H4 visa. But now she is on L1B visa.

    Q1: Can I add my wife as a co-applicant while booking the appointment online even though she is not my dependant )so that we can all appear for the interview at the same day and time)? I didn't find any guidelines related to this anywhere.

    Q2: We are looking for an appointment on Sep first week. Will the slots for Sept available by Aug 1st week? How many days before I can book the appointment?

    Yes. Your dependents can go for a H4 visa stamping provided you (primary h1 beneficiary) were always in status. (which from your post looks like you were)
    You will have to send your paystubs, latest h1 approval notice etc - with your family for the

    Hi this is my first post in IV ,i'm really glad to join this Community.

    I'm on OPT right now ,i'm done with my masters in DEC 2007.

    My visa Stamp in my passport was only untill april 2008(I got F1 stamped only for 18 months), now i'm on OPT extension.I applied H1B in 2008 and got RFE my employer could not answer the RFE and revoked my petition.

    I did't apply in 2009 even i have chance to apply(because of the JOB fear ) my OPT extension is going to end in June 2010 , any way i will be applying H1b in 2010.

    My question is if i don't get H1B in 2010 ,my plan i to take CPT and search for jobs ,does it effects my future immigration any way.

    My Posti is too long but try to understand i'm student and can't efford going to a attorney for this sort of questions.

    When Senate Majority Leader Harry Reid picked up his ball and went home after his staged all-night session last week, he saved from possible embarrassment one of the least regular members of his Democratic caucus: Sen. Ben Nelson of Nebraska. Reform Republican Tom Coburn had ready an amendment to the defense authorization bill removing Nelson's earmark funding a Nebraska-based company whose officials include Nelson's son. Such an effort became impossible when Reid pulled the bill.

    That Reid's action had this effect was mere coincidence. He knew that Sen. Carl Levin's amendment to the defense bill mandating a troop withdrawal from Iraq would fall short of the 60 votes needed to cut off debate, and Reid planned from the start to pull the bill after the all-night session, designed to satisfy antiwar zealots, was completed. But Reid is also working behind the scenes with House Speaker Nancy Pelosi to undermine earmark transparency and prevent open debate on spending proposals such as Nelson's.

    These antics fit the continuing decline of the Senate, including an unwritten rules change requiring 60 votes to pass any meaningful bill. When I arrived on Capitol Hill 50 years ago, Majority Leader Lyndon Johnson (like Reid today) had a slim Democratic majority and faced a Republican president, but he was not burdened with the 60-vote rule. While Johnson did use chicanery, Reid resorts to brute force that shatters the Senate's facade of civilized discourse. Reid is plotting to strip anti-earmark transparency from the final version of ethics legislation passed by the Senate and House, with tacit support from Republican senators and the GOP leadership.

    At stake is the fate of Coburn's "Reid amendment," previously passed by the Senate and so called because it would bar earmarks benefiting a senator's family members such as Reid's four lobbyist sons and son-in-law. Nelson's current $7.5 million earmark for software helps 21st Century Systems Inc. (21CSI), which employs the senator's son, Patrick Nelson, as its marketing director. The company gets 80 percent of its funds from federal grants, mostly through earmarks. With nine offices scattered among states represented by appropriators in Congress, the company has in recent years spent $1.1 million to lobby Congress and $160,000 in congressional campaign contributions. "As of April," the Omaha World-Herald reported, "only one piece of [the company's] software has been used -- to help guard a single Marine camp in Iraq -- and it was no longer in use."

    In requesting the 21CSI earmark, Nelson did not disclose his son's employment. "There's no requirement that he disclose that," a Nelson spokesman told this column. "But frankly, in this case, we didn't disclose it because it's so public." An April 24 letter from Levin giving senators instructions on how to request an earmark made no mention of the "Reid amendment" that had been passed by the Senate three months earlier but that required only certification that no senator's spouse would benefit from an earmark. Inclusion of Nelson's son, however, would be required if the ethics bill provision passes.

    When the defense authorization bill came up last week, Coburn prepared amendments to eliminate the Nelson earmark and the most notorious earmark pending in Congress: Democratic Rep. John Murtha's proposed $23 million for the National Drug Intelligence Center in his Pennsylvania district. Reid's plan to satisfy antiwar activists with an all-night debate averted debate, for now, on those two earmarks.

    Reid, the soft-spoken trial lawyer from Searchlight, Nev., has tended to suppress free expression in the World's Greatest Deliberative Body in his tumultuous 6 1/2 months as majority leader. Last week, he cut off an attempt by Sen. Arlen Specter, the veteran moderate Republican, to respond to him with an abruptness that I had not witnessed in a half-century of Senate watching. When Specter finally got the floor, he declared: "Nothing is done here until the majority leader decides to exercise his power to keep the Senate in all night on a meaningless, insulting session. . . . Last night's performance made us the laughingstock of the world." It may get worse if plans to eviscerate ethics legislation are pursued.

    Hey all,

    I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.

    I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.

    I am currently studying in the US on an F visa and have managed to loose my passport a couple of months ago. The passport itself is replaced but I hesitated to renew the I-94 since it takes longer time than my duration of status and it is cheaper to just leave the country and send a mail to USCIS later with proof of departure.

    To the problem, I am changing status from F to A. Since the interview is not required I was able to obtain the new visa through mail. Now, I am currently in the US with a valid new visa but no I-94 which means I will be out of status two months after my F visa expires. Being close to the Mexican border my plan is to cross it and come back on the same day to officially get the A status and a new I-94. I will of course send photocopies of all the papers and stamps to USCIS to not fall out of status on the previous visa. Are there any legal problems doing this?

    My parents-in-law visited the USA in the last week on B1/B2 visa. At the port of entry the immigration officer marked the expiration date on I-94 for my father-in-law for 6 months and however did not mark the expiry date on my mother-in-law�s I-94.

    As they are visiting first time they did not know the procedure and they could not bought this to the immigration officer�s attention before they left ?

    I assume they entered the expiry date in the system for my mother-in-law since both applications were processed at the same time with the same officer.

    How this can be fixed ?

    Is there any way I can call DHS and confirm the I-94 expiry date in the system ?

    If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.

    - recently obtained a duplicate passport for my stolen passport, unfortunately also lost I-94 when received in Dec.08.
    - Can I use the I-94 attached in the bottom of the I797? I won't have time to submit I102 and wait for replacement I-94.

    - I've a trip coming very soon to Germany, last year had obtained the H1b stamping at US consulate in Germany, will it be ok if I apply for restamping at the same consulate because of time factor I'm not able to Canada or Mexico or India.

    Any help and advise will be much appreciated. thanks !

    I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.

    Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
    (2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
    (3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?

    I know I'll lose the GC priority, especially wife's EAD, but I'm debating if it's worth losing my career aspirations? My info: Nov '06 EB2 PD, approved I-140, July 3 I-485 receipt and my present company will file our EAD/APs as long as it is necessary.

    I know a friend who has done Bachelors in Computer Application in india. She is now in US and wanted to know the options for working or studying in US.

    Is she eligible to take up MS degree..???

    Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...
