I have a approved I-140 with company A. It is a substitute labor.
I am getting laid off end of the month and I have a new offer from company B.
Can I port priority date of this I-140 to new company B? Does porting work for substitute labor also?

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.

I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

Hi all,


When started working for Company A it used to operated from 2 diffrent locations Newjersy ,New hampshire (Excutive office).
My Company applied Labor from NH in March 2005 (before perm).6 months back my case was moved to New York regional center ( i am not sure why it is moved to NY insted of newark NJ).
Recently they closed (in April 2010) the NH Branch .

What will happen to my green card ..? (labor is applied for NH location)

When i check with my employer he is saying NH location is Executive office it will not have any impact .
if reuqired he is ready open office in NH with new address

What should i Do...? i am totally in confusion state .. and now my dates current from july ,2010.

This shouldn't be a problem provided that she has the AP when she is leaving. AOS applicants don't need to be in the US while the AOS is pending, except to go to fingerprint appointments, interviews, etc. They must be in the US when the AOS is filed, and need to be careful to always have AP before leaving, but a 3-month gap should not be a problem.

My wife will be relocating to Toronto,Canada for work and I will be traveling between the US and Canada. My employer is fine with me telecommuting 50% of the time which means I will be working 2 weeks remote and 2 in the USA for the next one year. I will continue to be a US FTE [Software Development] and also pay US taxes. Will I be able to continue being on H1B status while I travel or do I have to explore other visa options? Since I will be returning to the US every 20 days [and by road] will I be able to use the automatic I94 revalidation?

It means Advance Parole. You will be eligible to apply for AP if your application for adjustment of status is pending with USCIS, and you need this document to re enter the US from overseas travel.

might be a simple question for u guys..
i have been reading in immigration articles abt AP document..
wht does an AP document means?\

The visa bulletin says "Effective Monday July 2, 2007 there will be no further authorizations inresponse to requests for Employment-based preference cases. All numbers available to these categories under the FY-2007 annual numerical limitation"


But doesnt that mean that no I485 authorizations will happen but filing can still be done and EAD received as de facto?

Please ask your respective lawyers to clarify this with USCICS/DOS.

Trying to get my green card (11 Years in the waiting) .

My I-140 was denied / and we have applied for Motion to Reopen . in the meantime, i have my AP approved this 2011. can i switch employer.

Dear Core Team,
What is IV's stand on people still stuck in LC backlog in PEBC/DEBC, There are applications pending there since 2001/2002. If this becomes law that I-140 filed after May 2007 will be rejected then the biggest impact will be on such people as even labor is not cleared and even after waiting for so long they will lose everything.

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..

They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.

so should i come to new program..if thats the case how to get an emergency appoitment.
