My wife has a valid H4 visa and she's currently in India as her company is applying for a fresh H1B visa for her. I'm currently in US on valid H1B visa till 7-Dec-2011.(Her H4 will also expire on the same date)
Qs: After getting the recipt for H1B application, can she travel on her H4 visa or does she have to wait till the approval\rejection of H1B?
Please note that this is not a case of H4 to H1 transfer.

Hello all, with the August bulletin showing June 06 cut-off dates, I have the following questions for which I seek input form IV members.
1. Is it possible to apply for the GC, the second time, if one cancels his GC "without prejudice"?
2. If yes, is it possible to use the priority date of the canceled GC in the second GC application?
3. What are the points one should be aware in canceling GC "without prejudice"?

She come her on H4, because her husband is here. She can come here again on H4, if H1 is denied. Why she is staying in India, if her family is here ?
What is the reason for denial ?.
If it is because of education, chances are less to get approval again.
Otherwise try another company.

Apologize for starting new thread, but this is an urgent request and need attention.
I need to respond to a RFE related to proving Programmer Analyst being a Speciaity occupation.
I researched and found a memo from Terrance Way, Director INS issued a memo on this on December 22, 2000 and is available on AILA Infonet
AILA InfoNet at Doc. No. 01040603
I couldnt locate this memo in USCIS policy guidance memoranda search.
Can some one with access to AILA Infonet, please send me this document

My Husband's I 140 got approved and his lawyer included my name as well in the I 140 application.
Can some one plss help me by letting me know if I can change to F1 for my further studies inspite of my name being included in the I 140 application

My employer is going put one newspapaer ad for two employee's. He is doing this to save moeny. Is this ok to put one ad for two employee's? Will there be any probelm in PERM.

You just need your approved EB3 I-140 notice
You need a copy of the approved EB3-140. Original is not required and you will not get it either. A copy should be available but depends on whether your employer/lawyer shares documents with you or not.

Can you use your spouse's cross-changeability after you have filed for your I-140 already ? How time consuming is this for the USCIS to acknowledge ?
i am quite sure you can...infact you can do this at any stage including after filing I-485.
please verify with an attorney...you will need one to do it correctly.

All,
I have my I140 approved under EB3 with the PD Aug'2003 with the employer A. Now I am planning to switch to employer B for filing Labor under EB2 category.
My question is Can I avail the PD i.e Aug'2003 got from the previous labor EB3 (i.s employer A) for the new EB2 labor with employer B.
My Exp: B.E + 8 Yrs of Progressive Exp.
Employer A:
labor : EB3 Approved PD AUG'2003
I140: Approved
Employer B:
labor: EB2 under process.
I would appreciate your reply, any attorneys pls.

Hello:
I got two EAD extensions in past and applied for the same third time. Earlier, EAD Renewals took only 2 weeks time ( from VSC). But this time it is not the case. It is still pending for 4 weeks now.
Are there any recent EAD renewals from TSC for anyone? Please let me know if anybody has similar case?
PS: Since my case(I-485) was transferred from VSC to TSC, I applied for EAD renewal at TSC this time.

just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...

I filed for my self, wife and two daughters I-485 and EAD with all documents but without I-140 recipt notice instead I enclosed evidences of the cashed check, INS online status print out and cover letter with reciept number.
My application reached on July 2 at 11:34am. No reciept yet. I called INS and representative explained my case will not be denied. If at all, INS will ask for the reciept notice.
I have my reciept notice for I-140 now.
At this point shall I wait or apply one more today with the reciept notice.

Hi,
I m without an assignment for about 3 months, but I m maintaining my status bcoz the employer is running the payroll with minimum salary. mean while i m expecting a full time offer from a company and they are willing to transfer the visa. so my question is that when the new company will be asking for the paystubs for the transfer, I have the paystubs which have a reduced(minimum) salary than what I was earning when I had a project, so will it affect my job offer or any questions will be asked by USCIS?
i know the questions are pretty open, I would appreciate any replies/advice on this,

USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.
Hence, it again is necessary to have an Approved LCA in place for the proper location at the time of the H-1B filing. The reason the exception was not extended is that the DOL assured USCIS that LCAs are being processed within the required seven-day processing time. The DOL, in fact, stated that LCAs are being processed within four to five days which is in fact true as well. It is our suggestion to plan accordingly.
