Just dropped a check for $5. I hope all of the remaining members do the same.
Mailing a check is just as good as a bill pay.
For those who are unaware as to what the "Bill Pay" option is, basically the Bill pay option is a great way to take advantage of your bank cutting a cheque as opposed to you cutting a cheque. That way you can write cheques without having to:
1) Actually write out a cheque
2) Spend money to post it (and take the extra effort to mail the cheque out).
Keep the contributions flowing.

It's call reseach topic.. We have to find some USCIS support documents for each case. We need some earlier USCIS decisions for each senarios/theories.
RG provided few supporting CIS rules in earlier post and seems logical. But not sure if RG or RK is right.
It's confusing indeed.
One of IV members 'lazycis' (he is a knowledgable & senior member) also mentioned this, which exactly matches with what RG said:
http://immigrationvoice.org/forum/showpost.php?p=301999&postcount=16
so I am sure there are some provisions. I hope 'lazycis' will provide some more info if he sees this post.
Edit: Chandu - please click this link to read on RG's forums. (http://immigration-information.com/forums/showthread.php?t=6461)

Somehow i still think PD will be important.People are wondering how they are gonna pull out earlier pd's from the thousands that will pour in.Well, while entering the file into the system, they have to enter all this data right,in order to issue receipts.Surely they have a way of sorting the whole file by PD,becoz they know that after the retrogression,as and when visa numbers become available, they can just haul out the files by PD and see if security checks and fp are done!!In this case RD's are useless, except for EAD's and AP's or maybe to sort out the apps among the current dates itself!!!!If so,they can allot a number and we see the green!!!I'm sure i am missing out some key plot point here...but i wish the processing was as simple as the above!!!

EB3_NEPA, I'm pretty sure that's how it works. They first use the regular EB3 numbers available.
Black_logs are you ABSOLUTELY sure that they eat into the EB3 numbers? On the Visa Bulletin, they have a seperate entry below the EB3. Just curious if we are getting this Schedule A thing correctly

It looks like they have heard from IV members about the spillover rules and their clarification about the QUARTERLY spillover is useful. Also them categorically stating that any spillover visas would be used in strict order of PD is reassuring. Whether they actually practice or not, it is good that they have gone on record as saying that is the way it should be.
In the past spillover was not applied in the way they are saying and EB2I suffered greatly for it.
This spillover rules if enforced will accelerate EE2I movement initially and then EB3. I suspect that by this summer EB2I folks from 2007 should be seeing some action.
I agree. It was interesting to see them use our style of predicting with and without spillover. It seems they have paid attention to the recent report we had published. We should continue to ask questions and provide suggestions to the administration officials.

ode to my green card (plagarized from lambi judaai from movie jannat)
Tere bin dil mera lage kahin na
Tere bin jaan meri jaye kahin na
Kitne zamane baad o rabba
Yaad tu aaya, yaad tu aaya
Aaaaa….aa..aaaaaaaa….
Khoya raha mein, saason mein apne
Aahat bhi teri, bhool gaya mein
Kitna jeeya hoon tanha raho hoon
Ishq tera bhool gaya hoon
---Translation
Tere bin dil mera lage kahin na - without you my heart is in nothing anymore
Tere bin jaan meri jaye kahin na - without you my life goes nowhere
Kitne zamane baad o rabba - after how many days, o god
Yaad tu aaya, yaad tu aaya - i remembered you, i remembered you
Aaaaa….aa..aaaaaaaa…. - Aaaaa….aa..aaaaaaaa….(no translation required)
Khoya raha mein, saason mein apne - I have been lost, just breathing
Aahat bhi teri, bhool gaya mein - your footsteps, i have forgotten
Kitna jeeya hoon tanha raho hoon - just been living, been so alone
Ishq tera bhool gaya hoon - that I have forgotten your love

America has always been a favorite destination for immigrants. In the past, labor jobs were abundant and there were enough immigrants to do those jobs. This mutual dependency contributed to the growth of the United States making it the fastest growing industrial nation in the world. Things have changed, labor immigrants have been replaced by high-tech and skilled immigrants, but two things have not changed. 1. America depends on immigrants to sustain growth and 2. Immigrants come to America to fulfill their dreams. This 300 year old interdependence is very important yet under appreciated by the lawmakers.
Skilled workers of foreign nationality are well educated, creative and ambitious individuals. They act as a steroid for the nation. They charge the nation with prosperity and growth. Generally countries depend on their younger generation and hope that they will become highly productive and good citizens contributing to the growth of their nation in future, however only few countries are blessed with the strong stream of immigrants with highly desirable qualities to make progress today, not tomorrow. It seems America is highly blessed in that regard. But unfortunately the lawmakers dont seem to recognize how fortunate their country. Following facts support my observation:
1. World has entered information and biotech age. India and China has the biggest technological talent pool
waiting to settle down in USA, yet the immigration quota for these countries is locked to extremely small
and fixed number for decades due to half-century old laws. The laws does not take reality into account.
2. In the days of online stock trading, visa processing is still done at extremely slow pace.
3. The positive impact of immigrants has been taken for granted.
4. Immigration is considered a charity rather than an important factor in countrys growth. The attitude is not right.
If such ignorance continues in the United States following will happen:
1. Innovation will slowdown. It has already begun.
2. Technology companies will migrate to India and China.
3. Large scale outsourcing will occur for technological and knowledge based jobs.
4. Stock indexes will move south, as there wont be many attractive places to invest money. High profits normally come from high growth companies and todays high growth companies come from technology sector.
5. Tax revenues will decrease, which will affect all government activities including defense and public education.
6. The effects of illegal immigration will become severe as Americans will compete for low wage blue collar jobs as a result of outsourcing.
7. Severe retrogression in immigration will not allow skilled workers to settle down or adapt to ever changing skills market. It will hinder the growth of each skilled worker due to lack of long-term planning, long-term investments and developments. These people will not be able to plant the trees that can reap the fruits for generations to come.
8. The effect of not having skilled immigrants in the country will not be zero , but it will be negative and counter-productive as most skilled workers will go back to their home country and instead of contributing to the growth of America , they will compete.
9. National moral level continues to decrease as more American citizens are going into jails than good foreign nationals coming in!
All these effects will be slow in the beginning, but will be visible when it will cross the tipping point. A place from where there is no return.
The solution:
Remove the limit on immigration quota for technology professionals for 5 years to solve current retrogression crisis. There after update the quotas (increase or decrease) every year to keep delays constant at 1,2 and 3 years for EB1,EB2 and EB3 categories respectively.
In my view, 5 million well educated and talented legal immigrants are always better for the country than 5 million illegal immigrants. Its better to rely on technology to improve American life style than on illegal immigrants to do cheap labor.

That is the victory due to our admin fixes campaign. Your thousands of letters are working here.
We had received good feedback in our meetings with the administration.
The whole process of making final announcements is just too slow!!
We recently had another meeting to discuss one more admin fix item that has not been addressed yet and was part of our letters. Let us hope some decision comes out soon enough.
Thanks IV...thanks a lot.

i support your efforts and have printed out and sent letters to the people mentioned. Momentum for release of information should build up even if we have 50-100 letters from affected people...otherwise people won't know of EB-3 IND's plight.
I suppose we should followup with phone calls in 15 days to cement our request. We should have a poll on who all has sent the letter and made the call.

Mass porting to EB2 category is the only option. I think most people with old EB3 PD can easily do it. I was reluctant initially but since there is no light at the end of the tunnel, why not take a chance while PD porting is still available. Dont get discouraged by people advising against it, since there is no hope for EB3 anyways.

Just an update from my side:
I have just talked local Congresswoman's Office and I have talked to a staff member for 1 hour and she is helping me. She is going to call NSC and get to the root cause of this problem.
Guys,
If you are reading this, do not lose hope. We have to try every avenue and knock every door that is open.
would you mind sharing what city you are in as its good to know that your local congress woman's office is helping you...

which cap on Nurse are they talking about. Is it the EB cap or H1B cap?
They voted YES to include amendment to eliminate EB visa cap for Nurses (India, PHI)
Will send the Nursing comm into raptures if it finall passes into law. Strong indications that it will make it. Of course that will have major impact on EB3 numbers, I guess
