I know 3 friends of mine who got an email for USCIS rearding the GC approval. They all had priority dates around April-June 2004 EB3 India. These are the lucky ones who got labor cleared in 2-3 months (just prior to BEC/PERM) and had filed 485/140 concurrently.

Well my friend people here will tell you that once you use AP your h1B is not valid any more thats not true. I confirmed this with 2 Immigration officers and my attorney. AP and h1b have nothing to do with each other. One is an entry permit the other is to work with a specific company. no link so use you AP at re entry when IO ask why did you go to india don't say vacation. thats all.

Folks,
This is just a suggestion. Talk to your local Sears/Macys/Food4Less/etc/Indian Groceries / Deals2buy.com to collaborate in purchasing the coupons so that people can go get the coupons and present it to the respective stores. In the process say get a portion of it being contributed to IV. Work out some percentage model in which case it would be easier for people to contribute that extra amount instead of separately pulling out their card (people are lethargic to do this) and contributing to the google check out fund drive. Of course the other one is just another supplement of getting funds

If you are eligible to file I-140/485 now then how come you are stuck?
Remember nothing has become law yet..
MY employer is a consulting company and i had a rfe to my h1 extension for 8th yr so he wants to wait to answer rfe , then get approval and next file for next stages. I have tried all the ways to make him file and not able to.I just hope the new labor laws will help. Acc to that he shud file for next stages in 180 days starting july 15 th right. What is this May 15 thing?Any inputs. Thanks in advance.

You are being too naive by giving benefit of doubt to senators and blaming some lowly staffer. The senators and there cohots (aka ron hira etc) who wrote this law wrote it specifically so that
1. to make it difficult to get green card through h1b route
2. make life even more difficult for people already stuck in retrogression.
I wonder where the famous "compassion" that both democrats and republicans talk about while giving amnesty aka Z visa to illegals who came here as early as Jan 1 2007 but are sticking it to us EB folkes who have been here following the rules and paying taxes for the last 7 to 8 years.
If the current law passes , god forbid it wont. It is indeed scary to many : Becoz its primarily becoz of all backlog processing centre Labors, H1 sixth year extensions etc. I dont know how the heck designed this draft and i am sure all those senators wouldnt havebeen aware of all these H1B , GC Employment based numbers some staffer would have done this .

I think they have to be current when they get an appointment or something like that. I am pretty sure that they accounted those 18k as CP numbers
Definitely not when you get the appointment. I am 100% certain of that. There have been cases of people going for the consular appointment and not getting it as dates retrogressed.
Only possibility is that the cases up to May were the 66K for 485s PLUS 18K for CP throughout the year until may. Right now noone wanting to get into the system will go for CP.

What is wrong with bonded to 1 job type ? You file AC21 but job type should be similar. You cannot become a company's Vice president if your labor was for Programmer, why are you picking on things ? The guy sitting next to my cubicle is here more than 7 years, he's waiting for his 140, he's stuck with my employer while he wants to move since he has a 3 years degree than a masters, He was considered a EB-3 I. Don't you think he wants to know how many decades it will take for his dates to get current ?

They are wasting EB visas every year giving reasoning they were too busy putting up a crying face saying we got bombarded with this application and those applications, they are screwing up our Travel plans by not Issuing AP documents in time, they are screwing our jobs by not issuing our EADs in time. I am telling you the biggest villian in all the mess we are in is USCIS and you are telling me there's no point to discuss this ??????

I really envy all of you guys who can return to your country. I have been here 8+ years and I am 53. My country does not even give me a passport and in top of that I am stuck in the namecheck black hole.

Can the members in Texas and others call on Sen. Cornyn's office and ask him to support the bill. I just called their office, and the staff says that he has no statement from the senator, and therefore has no position as of yet. I asked him about the above report, and all he offered was "no comments"
Hope IV members step up their efforts in calling the list of Senators and post their feedback on this forum. We can learn from each others feedback and bring more pressure on these legislators.
Not sure why they are so inconsistent, I called Sen. Cornyn's office an hour ago and spoke to one of his staff members, they told me Senator does not support the bill because of the issues he has will parts of the bill which provides undocumented works a path to citizenship, but we had a good a good conversation about the legal immigrants issues and potential solutions in the bill. She promised to convey my message to the senator.

Still USA is going to e attractive destination unless currency goes less than 30 rupees. Still USA is Top in innovations in medical, Biomedical and core products like Apple, Microsoft etc. India and China are going to to do service oriented jobs and hardly any big innovations. That is going to continue for next few years. Also survival is easy here compared to India as population is 4 times than USA and country is 1/4 of USA. It is a mere speculation and our wish that US citizens will wait in line for Indian visa. But it is a fact that we do not need to come to USA just for money as we can get excellent pay package in many industries in India and quality of life improved a lot on par with USA. Still population growth with less land will make lack of facilities for many people in future decades. Mainly water, food,land and energy shortage will be a problem in next decades and we need to wait and see how our government handles that.
May be our kids in future will have to wait inline for Indian Residency:p

I submitted the 485 without the VSC hoping that it will be ready by the time USCIS issue RFE on this. Do you know when we can expect the RFE after the submission?
Visa Screen is needed to adjust your status. It is always better to have your visa screen ready. USCIS will send an RFE for that. However, while AOS is pending, EAD can be issued.

A number of inquiries have come to us regarding delays in PERM labor certification case adjudication. Beginning early in 2007, there has been a noticeable slowing in case processing at the U.S. Department of Labor (DOL) Atlanta Processing Center. This center is one of two locations where PERM labor certifications are adjudicated. The other location is in Chicago. This slow-down is a marked change from the generally fast PERM labor certification decisions that had become the norm.

We at the Murthy Law Firm made inquiry about this matter, to gain some insight into why things had changed, and, of course, to determine how the situation might be improved. We were advised that personnel temporarily had been reallocated away from the PERM cases. The Atlanta Processing Center also processes temporary labor certifications needed in H2B cases. Due to demand and time constraints, personnel were diverted to work on the temporary labor certifications, which meant delays in the PERM labor certifications.

Our sources indicate that the DOL adjudicators in Atlanta will be moved back to their regular responsibilities of processing PERM cases in the near future. Thus, PERM cases there should start moving again soon.
may 11 was five weeks back......its third week of june right now!!!
Still no favorable movements...I do not wanna miss this July deadline....I am sure dates for EB3 will retrogress in August.....then ticket to India and UAE!!
