Hi All,
My Green card Priority date is April 2004 under EB3 category.
I-140 was approved 1yr back and I-485 applied in August 2007.
Where to check the current processing dates and when will we receive Green card?
Any idea still howmuch time will it take to get GC for the people with above PD date?
Do i need to check the URL https://egov.uscis.gov/cris/jsps/ptimes.jsp?

USCIS has announced that it is working on a rule to create an electronic registration system for H-1B employers subject to the annual cap. Employers would first register an application and be allocated an H-1B cap number and then would file the case. The idea is that employers would need to register to claim an H-1B cap number first and then if they are selected, they then would prepare and file the case. hello...
I was on H1.. but i quit my job and i am currently enrolled as a Full time student.
I need to go to Mexico as part of my Study program....
I have received the change of status from USCIS..but i need to get my passport stamped..
I have not been successful in getting an appointment in Canada....
>> Can i go to mexico and get the visa stamped during my stay there..is it risky???
>> i cam here on F1-h1-now back to F1.... do i have to go to my country of origin to get my visa stamped.

I filed my I-140 at NSC, but when I check case status online it says my I-140 was transfered to another Service center. It does not say which Service center though. My lawyer says he got all his mails form CSC, which means my I-140 is pending at CSC. Also my case number starts with WAC-XXX-XXXX, which also suggests that my case is pending at CSC. However, I am not convinced if this is correct because CSC does not publish processing times for I-140. Also, recently when I filed AR-11 for an address change I got an email from USCIS with the address of TSC on it. I would like to know if anyone is in the same boat and knows which service center there case is. I will appreciate your feedback.

If you have a phd, is it automatically EB1? or do the rules of employment should call for phd apply?

Here is our situation. I am on H1 and have 485 pending for me and my wife. Both of us also have a valid EAD.
My wife was on H1 too, however since Oct'08 she relinquished her H1 status and took up another job using her EAD. Currently, we are planning to have her AP filed (her earlier AP expired in Dec'08).
Given all this, I have following questions.
a). Are there any risks associated with filing AP.
b). I presume her status has been valid so far... reason I ask is that we didn't do anything special in terms of communicating any official agency, when she jumped the boat from H1 to EAD. Were we supposed to?
c). Do you think I can get her on H4 while she continues to work using her EAD. I guess H4 option is more expensive? Any thoughts?

I have a few questions regarding my H1B and I-140 since I am planning to change my employer.
1) If I change my employer, can my old employer retain my I-140? If he retains my I-140 and in case if the GC dates become current can I switch back to my old employer along with H1 and get my GC through old employer? Will this situation involves complications?
2) After my H1B transfer is approved with new company, when can I go for H1b stamping? Can I go immediately or wait for 1 month or so, in order to run 2 pay checks with the new company?
3) I had my initial H1B visa stamped from Bahamas. Can I still go to US neighboring countries to get my H1B visa stamped since mine is H1B transfer/extension and not change of status or do I have to go to India?
4) If I have my H1B stamped with old employer, and later transfer my H1b, Will I be able to travel to India with H1B stamping from old employer or Do I need to again have my H1B stamped?

Your passport has nothing to do with you invoking AC21. AC21 is just a way of informing Uscis that you are switching to another job with similar duties, that's all. There's no official form or application to submit.
Just apply for the renewal of your passport as you would usually do. That's all.

My employer has been holding back my wages on some excuse or the other. Since I was awaiting my GC, I had no choice but co-operated with them. I got my GC last year in July 2010. I worked with them until September 2010 and due to this payment situation, I have chosen to work elsewhere.Now they promise to pay the back wages from 2010 but the payment never arrives. Repeated followups, emails and calls have yielded the same result. I am not sure what are my options here at this point. I no longer work for that Employer since they never pay on time.

* AILA has reported that during the period of July, August, and September 2007, Nebraska Service Center and Texas Service Center adjudicated 60,000 plus EB-485 applications. Since EB visa number was unavailable for the entire EB cases in August, presumedly a substantial portion of these cases could include those cases for which the EB visa numbers were pull out before July 2, 2007 in June and adjudicated throughout the period as reported by some I-485 applicants who reported that their I-485 applications were approved when the visa number was unavailable. Wife need to go to India for emergency. Advance Parole expired. Can she already leave while I apply AP now ? Or does she have to be in country until we get it ? Can i apply now and send it to her once i get it here ?
