There is a different thread also going on, but sharing it here for anyone who have not noticed it yet. RG updated his website with below information.

After the july fiasco, USCIS need not have to worry about recieving huge applications if they move the dates forward. Since almost all the folks (except for folks stuck at BEC) would have turned in the applications uscis should be able to move the dates forward for FY08 to a big extent , so that visa numbers are not wasted.

but again it all depends on how they view this. These are cry from our end..

Yup, because of July '07 there will be no wasted visas for several years...

I am wondering whether USCIS made that mistake on purpose, after the immigration reform thing failed in congress?

this is a 2004 EB3 approval! This is the first one I am seeing from 2004. So looks like they have really cleaned the pipes here, and things should be better going forward.

The nicest thing of this whole fiasco is that they seem to have ignored country-limits and approved as many as possible. Last year they did only 9.8K EB Indians (teh final count was 17k, but that was due to ScheduleA). THis year (2007) if they have gotten 20-30K India applications out, the dates should move better in the future.

    Eagerly awaiting 2 USCIS stats:
    1. per-country per-category EB approvals in 2007
    2. number of 485 applications received by August 17th

They indeed are clearing up the pipes, so the situation is not as horrible as it seems to be. A pd of 2004 is considered "old" so as soon as visa nos become available in october, they would be the first ones to get approved.

I have applied for labor certification in Dec 2006. In may 2007 I got a denail stating that the company is not "bonafide". It is a new company and I am the 1st applicant for labor. We sent all the supporting documents and requested for review/appleal in May 2007. Since then we did not get any status from them. My attorney called them last week and made an inquiry. DOL Atlanta said that they need to do the "central check" of teh company. They do this for every new company. Does anybody aware of this "central check". How long it will take?

On a serious note: Our situation is not comparable with Independence War, we will not die if we don’t have GC, we all are doing Well/Good/Okay but our lives could be lot better if we have GC by NOW, not X years from now, we need it NOW. But seems to be we have made compromise with the situation and one way or other we are floating with our lives. Initiatives like Hunger Strike may not work well but some sort of Flower Campaign/similar initiatives may work well. Monthly donation seems to be upsetting because they can’t tie it straight with outcomes, its hard to keep people on the hook for long, everybody is expecting it to happen sooner and Lobbying works slowly, it’s the reality.

My husbands DL expires on Oct 1st, 2007. The North Carolina DMV insists that he should have a valid H1B visa stamp in his PP in order to renew the license. He does have a valid H1B extension with I-94 at the bottom till Oct.2009. We dont want to leave the country as we are filing for our I-485's.

Any one in NC have any suggestions?

We recently went got our driving licenses renewed with our H visa extension I-797s. DMV didn't ask for an unexpired visa. All they wanted was a visa stamp in the passport to make sure that we legally entered US.

Not everybody on this forum earns 144,000 a year. What world are you living in my friend? Do you not get out that often?

    I agree.

Many of the military families affected only earn $25,000. I find it repugnant when
someone shows how little he cares about his fellow human beings.

Did you ever apply for EAD / AP?

My I-140 was never denied. In fact the date 09/04/2007 that NSC mentions about the denial is the date that I got approval notice. I have the approval copy from USCIS. I am not sure what the adjudicating officer is looking on his terminal.

bharol, You and I have same Priority Date and Category Mine is also PD 3rd Sept 2004 ( EB-2)

Let me know when you get your approval
Looking at the recent approvals looks like USCIS does the following:

    1. Pick up x number of files using a random algorithm.
    2. Arrange these files in a random order using the same random algorithm
    followed in step 1.
    3. Randomly pick any file arranged in step 2.
    4. Toss a coin.
    5. On odd dates if it is heads, approve the file. On even dates if it is tails
    approve it.
    6. If file is not approved in step 5 put it on the shelf to be picked up
in step 1 in next cycle.

Its not a rumor. This is real. Coming to think abt it, he had filed a labor in 2000/2001 time period and had abandoned it when he switched companies. I am wondering if USCIS takes the oldest one an applicant had ever filed.

There you go.....See thinking does help;-).....anyway seriously dude......do you think USCIS go that level to go pick up your friends abandoned labor.....and do the PD Porting without your friend asking for it.....I will be damned...if this is true.....

We're much better off here in the US when you compare our compatriots suffering in Britain. Britain has enforced a lot more regulations on immigrants, much to their chagrin.

Let's grin and bear it and hope to see the 'green' light at the end of the tunnel.

That's exactly the point..USCIS is HEADED by fools...the problem lies within...the heads dont really care if their staff is underpaid and over-worked..but the fact of it is that they just don't have the money nor manpower to get the work done. When USCIS adjudicated all those cases in 2002, it was not of their own volition but because Congress mandated it..6 years later they dont care for the immigrants..u think they'd (policy makers) care 2 hoots for the the USCIS officers...just take a look at the Infopass centers...from my experience I havent seen more than 2 officers helping customers at a time..no money..no manpower

I think u r right. We shouldn't think abt our future in this country and nor abt the people who were in backlog as we r the one's who suffered the most.Y we have to suffer because of mis-communication between DOS n USCIS.If they will be taking our reaction in negative way let them. If they want to revive CIR(Legal immigration-point system) , let them do. If they do, the same as British did , let them. Let see our present, don't worry about future. If they think to throw us back to our home country ,the right they have , let them do. But i just want to say is that- if they made an inquiry over this issue, not only they'll hold all backlog cases that r approved now but also they will stop issuing new visa numbers till this is resolved-result -delaying the process more. It will definetely take time. The thing is atleast backlog is cleared now, so the process will move smoothly. But anyway lets fight for injustice done to us.Lets don't wait for oct opening. We want now!!!
For last 2 weeks of June , we worked hard and delivered our application on 2nd july. Lets Do IT GUYS!!!!!:)

    EB-3;PD-March'2004

My brothers in blood, please calm down Mahatma Gandhi had his own way of fighting for freedom and so did Subhash Chandra Bose. They must have agreed and disagreed with each other on many things. But at the end of day, their motive was the same Justice and Freedom.

We might have our differences, our opinions and ways of doing things, but we need to understand that our motive is the same. We should stop bickering with each other and concentrate on the main goal. We should keep encouraging our members to join hands and unite and fight for the cause.

Though you might not agree with each other, you still need to see how severely the issue must have affected the other person which is why they are here and ready to fight.

Please pull your swords to fight the injustice rather than fight with each other.

    PEACE!
